Botanical Forest Product Harvest Permit

Nisga’a citizens who have obtained a botanical forest product harvesting permit are usually entitled to pick pine mushrooms anywhere on Nisga’a Lands. They are not limited to the area around their community. If areas are restricted for conservation and/or safety reasons, gates will be closed in those areas. Nisga’a Lisims Government protects areas that produce pine mushroom and other valuable botanicals. Significant constraints limit any industrial activity in these areas. NLG is committed to the sustainability of these non-timber forest resources. Proper harvest techniques promote future harvests. Please remove any garbage you may come across.

Permit Conditions / An eligible person may apply to the Directorate of Lands for a botanical forest product harvesting permit.

• An application for a botanical forest product harvesting permit must be in a form specified by the director.

• Contain the information required by the director, and

• Be accompanied by the payment of any prescribed fee.

• The director may issue a botanical forest product harvesting permit.

• A botanical forest product harvesting permit must specify the species of botanical forest product that may be harvested under the permit.

• Must be for a term not exceeding one year.

• May limit the volume of the botanical forest product that may be harvested under the permit.

• May specify the area of land from which that volume of the botanical forest product may be harvested, and

• May include other terms and conditions, consistent with this Act and the regulations, that the director considers necessary.

• A botanical forest product harvesting permit does not provide its holder, either on or before the expiry of that permit, with a right to a replacement permit.

• A holder of a botanical forest product harvesting permit must not assign or transfer that permit without the prior written consent of the director. Individual and Group Botanical Forest Product Harvesting Permits

• An individual botanical forest harvesting permit authorizes the holder of the permit to harvest botanical forest products in accordance with the Nisga'a Forestry Act, the regulations, and any terms and conditions set out in the permit under section 17(5).

• A group botanical forest product harvesting permit authorizes the holder of the permit, and any other individuals that the holder of the permit wishes to allow to harvest under that permit, to harvest botanical forest products in accordance with the Nisga'a Forest Act, the regulations, and any terms and conditions set out in the permit under section 17(5).

• The holder of a group botanical forest product harvesting permit who allows other individuals to harvest under their permit must provide to each such individual documentation satisfactory ot the director that identifies the individual as someone allowed to harvest under the botanical forest product group harvesting permit, and ensure that each such individual is aware of and observes the provisions of this Act and the regulations in respect of the lawful harvesting of botanical forest practices, as well as any terms and conditions set out in the permit under section 17(5).
